UNFILED BACK TAX RETURNS

We have seen many taxpayers who have ignored IRS requests and ended up paying tax, penalty and interest on overstated income or legitimate deductions.

Offer in Compromise - OIC
An IRS Offer in Compromise allows taxpayers that cannot afford to full pay their back tax liability the opportunity to settle for less than what they owe. The IRS sets guidelines for accepting an Offer in Compromise. The IRS looks at a taxpayer's past, current and future financial situation when evaluating whether an Offer in Compromise should be accepted. It is important to know what aspects of a taxpayer's situation the IRS is looking at when filing an Offer in Compromise. Not everyone qualifies for an Offer in Compromise, as each person's financial situation is different. Thus, pre-qualifying for an Offer in Compromise is an important step to take prior to attempting an Offer in Compromise with the IRS.
Installment Agreement
An Installment Agreement with the IRS allows taxpayers that cannot afford to full pay their back tax liability the option to pay their back taxes through monthly payments. There are guidelines regarding how the IRS determines the payment amount and time frame for the agreement. Additionally, a taxpayer must be compliant with all past tax filings before establishing the agreement. Depending on the circumstances and the amount of time that the IRS has left to collect the tax debt, the Installment Agreement may pay all or part of the back tax liability.
Currently Not Collectible
Currently Not Collectible (CNC) Status is when the IRS removes a taxpayer's account from active collection efforts. The IRS has requirements that an account must meet before it can be placed on a CNC status. Once the account is placed on a CNC status, the IRS does not pursue collection activity against the taxpayer and the statute of limitations on the tax liabilities will continue to run. Unless the taxpayer's financial situation changes, the account will remain on a CNC status until the tax liabilities expire.
Wage Levy / Wage Garnishment / Wage Attachment
The purpose of the IRS is to collect taxes on behalf of the federal government. If a taxpayer does not pay their taxes, the IRS will demand payment through phone calls, field visits and letters. If the taxpayer disregards the demands for payment the IRS will give legal notice that it will be resorting to other means to collect the taxes. One method that the IRS uses to collect the overdue taxes is through wage garnishments. We constantly conduct negotiations to release wage garnishments for our clients.
Bank Levy Release

Innocent Spouse Relief
An Innocent Spouse is spouse "A" who has become liable for income taxes from a joint return filed with spouse "B" when spouse "B" has caused the income taxes to underpaid by mistake or fraud, and spouse "A" signed the return believing the return to be true and correct. For spouse "A" to be entitled to relief under the Innocent Spouse rules, spouse "A" must be able to prove when signing the returns, he or she did not know or have reason to know that at the time filing, the return either understated income or overstated deductions.

Federal tax liens are a public record stating that you owe federal taxes and are filed in the county you live.
Because the tax liens are public records they will show up on your credit report. This often makes it difficult or impossible for a taxpayer to obtain financing, even for an automobile or home. The tax liens need to be reviewed to determine if they are valid. If the tax liens are valid, a strategy must be developed to deal with the IRS tax liabilities.
